Winkme Drop — Terms of Service

Winkme Drop is operated by SKYHIGH INVESTMENT HOLDINGS PTY. LTD. (ABN: 47 607 693 658) (“Winkme”, “we”, “us”, or “our”). By creating an account or using the Winkme Drop platform (the “Service”), you agree to these Terms of Service (“Terms”). Please read them carefully.
We may update these Terms from time to time. Continued use of the Service after any update constitutes your acceptance of the revised Terms. We will notify you of material changes via email or in-app notification.
1. Eligibility
You must be at least 18 years of age and currently residing in Australia to use the Service. By registering, you confirm that:
- All information you provide is truthful, accurate, and up to date;
- You are not prohibited by law from using the Service;
- You are using the Service for personal, non-commercial purposes only.
If we reasonably believe you are under 18, your account will be suspended or terminated immediately. We comply with the Australian Online Safety Act 2021 regarding the protection of minors.
2. About Winkme Drop
Winkme Drop is a weekly curated matching platform designed for working professionals in Australia. Our core philosophy is to reduce meaningless browsing and appearance-driven selection by:
- Matching based on values, lifestyle, and personality—not looks;
- Delivering one curated match per week to opted-in members;
- Verifying employment status to serve working professionals;
- Requiring members to opt in each week, promoting intentional participation.
No infinite swipe feed. One match. One week. One connection at a time.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials. You must not share your account, use another member's account, or allow any third party to access your account. Notify us immediately at winkme.chat@gmail.com if you suspect unauthorised access. You are solely responsible for all activity under your account.
4. Privacy and Personal Information
We collect, hold, use, and disclose personal information in accordance with our Privacy Policy (available at winkme.dating/privacy) and the Australian Privacy Act 1988 (Cth), including the Australian Privacy Principles (APPs).
Information we collect includes:
- Registration details: name, email address, date of birth, gender, employment information;
- Profile content: values, lifestyle preferences, photos, and self-descriptions;
- Usage data: device information, app activity logs, IP address;
- Location data (with your consent): general location to facilitate local matching.
How we use your information:
- To provide and improve the Service, including weekly matching;
- To communicate with you (match notifications, service updates);
- To verify eligibility (age and employment status);
- To comply with legal obligations.
Disclosure: We do not sell your personal information. We may share it with trusted third-party service providers (e.g., email delivery, cloud hosting, analytics) under confidentiality obligations, and only as necessary to operate the Service. We may also disclose information to comply with Australian law, a court order, or a government authority request.
You have the right to access and correct your personal information at any time. Contact us at winkme.chat@gmail.com to make a request. We will respond within 30 days, as required under the Privacy Act.
5. Non-commercial Use
The Service is for personal use only. You must not use Winkme Drop to:
- Solicit, advertise, or promote goods, services, or commercial activities;
- Recruit members for other platforms or businesses;
- Conduct any activity for financial gain.
6. Acceptable Content and Conduct
By using the Service, you agree not to post, transmit, or engage in content or conduct that:
- Is sexually explicit, violent, or offensive;
- Harasses, bullies, threatens, or discriminates against any person;
- Is false, misleading, or deceptive;
- Solicits personal information from other members for non-dating purposes;
- Involves impersonating another person;
- Contains spam, chain messages, or unauthorised advertising;
- Includes another person's photo or personal details without their consent;
- Promotes illegal activity or violates any applicable Australian law.
Violations may result in immediate account suspension or termination, and may be referred to law enforcement.
7. Your Content
By posting content on the Service, you grant Winkme a limited, non-exclusive, royalty-free licence to use, display, and distribute that content solely for the purpose of operating and improving the Service. You retain ownership of your content. You represent that you own or have the rights to any content you post, and that it does not infringe any third party's rights.
8. Intellectual Property
All platform content, design, trademarks, and software owned by Winkme (“Winkme Content”) are protected by Australian and international intellectual property laws. You may not copy, reproduce, modify, or distribute Winkme Content without our prior written consent.
9. Termination
You may delete your account at any time via the account settings page. We may suspend or terminate your account at any time if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections 4, 7, 8, 11, 12, and 13 survive termination.
10. Third-Party Links and Services
The Service may contain links to third-party websites or services. We do not endorse or take responsibility for third-party content, privacy practices, or services. Your use of third-party services is at your own risk.
11. Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by Australian law (including the ACL), we make no warranties regarding accuracy, reliability, or fitness for a particular purpose. We are not responsible for the conduct of any member, whether online or offline. We do not guarantee that you will find a match or that matches will result in any particular outcome.
Nothing in these Terms excludes, restricts, or modifies consumer guarantees or rights you have under the Australian Consumer Law that cannot be excluded by law.
12. Limitation of Liability
To the fullest extent permitted by law, Winkme's total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us (if any) in the three (3) months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
Nothing in these Terms limits our liability for death, personal injury, fraud, or any other matter that cannot be excluded under Australian law.
13. Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
We encourage you to contact us first at winkme.chat@gmail.com to resolve any dispute informally. If we cannot resolve the matter within 30 days, either party may refer the dispute to the relevant Australian dispute resolution body or court.
14. General
If any provision of these Terms is found to be unenforceable, it will be severed without affecting the remainder of the Terms. Our failure to enforce any provision does not constitute a waiver. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Winkme regarding the Service.
